1. General information from the Syngenta Pension Fund
These terms of use regulate the use of access to the pension fund web portal ‘PK/S.Live - Web portal’ (hereinafter referred to as the web portal). This web portal provides web-based functionalities and services.
These terms of use apply to all registered users who make use of the services of the aforementioned web portal. The service is provided and maintained by PK Softech AG, in addition to the PK/S administration software, and is operated and managed by the Syngenta Pension Fund (hereinafter referred to as the Foundation). References to people in the Terms of Use refer to both male and female individuals.

The Foundation's web portal can be used by all insured people who have successfully completed the registration process for the web portal.
The use of the Foundation's web portal is governed by these terms and conditions. By accessing the Foundation's web portal, the insured person declares his/her agreement with these terms of use and recognizes that they are binding.
2. Services of the web portal
The services offered by the Foundation as part of the web portal include the use of the web application and its functions, the exchange of information between the insured person and the Foundation or its administrative and partner systems, the provision of various information guides (e.g. online web videos) and any documents, as well as insured person support for the portal.
The insured person can view data and carry out calculations or simulations in the web portal. It is not possible for the insured person to intervene directly in the Foundation's administrative systems.
The current range of services offered by the web portal for insured people is listed below. It can be expanded or restricted by the Foundation at any time. Any planned temporary or definitive restriction or expansion of the range of services will be notified to the insured people in good time in an appropriate form.

- Display of documents (e.g. insurance certificate)
- Printout of documents
- Carrying out simulations
- Voluntary purchase
- Retirement
- Change of contribution scale
- Divorce
- Leaving the company
- Early withdrawal for home ownership promotion
- Change password
- Two-factor authentication: Change the delivery of the confirmation code
- Change the notification for document delivery
- Customer counselling and support by a member of the office team to answer operating problems relating to the Foundation
3. Functionality of the web portal
The insured person can view their account data such as insured salary, retirement savings, insured risk benefits, etc. The data in a user account can only be viewed by the respective insured person.
4. Use of the Internet
The Foundation pays great attention to the security and interference-free operation of the web portal. All use of the web portal takes place via an encrypted, secure and authenticated Internet connection, which is also used as a de facto standard in the area of online banking.
Despite the best possible precautions taken by the Foundation or by the providers it uses, the security and freedom from interference as well as the up-to-dateness and confidentiality of the data displayed or transmitted via the web portal cannot be fully guaranteed due to the public nature of the Internet.
The use of the web portal and the Internet is therefore at the user's own risk. Users are advised to take their own additional precautions to increase security (firewall, virus protection, security patches, etc.) and to activate the security settings recommended by the relevant manufacturer for the hardware and software they use.
The use of the web portal and the storage of data and documents on the user's work devices are at the user's own risk.
5. Scope of use
The web portal is generally available to the insured person at all times. However, due to the nature of the Internet and maintenance work, permanent availability may be limited. The Foundation's web portal is made available for simple, non-exclusive, non-transferable and intended use. This includes, but is not limited to, the retrieval, transmission, downloading, storage and reproduction of data and information as well as the internal use of programmes or parts of programmes within the meaning of these terms of use. Any other use of the Foundation's web portal is prohibited.
6. Intellectual property
Information, brand names, design and other content of the web portal may not be changed, copied, reproduced, sold, rented, traded, used, supplemented or otherwise utilised in any other way without the prior written consent of the Foundation.
Apart from the rights of use or other rights expressly granted herein, the user is not granted any further rights of any kind, in particular to the company name and industrial property rights such as patents, utility models or trademarks, nor is the Foundation under any obligation to grant such rights.
In so far as the insured person deposits ideas and suggestions in the web portal, the Foundation may utilise these free of charge for the development, improvement and distribution of its products from its portfolio.
7. Maintenance and support
The Foundation's web portal is maintained on an ongoing basis and updated as required. Maintenance and updates are carried out at off-peak times wherever possible. During maintenance and updating work, the availability of the web portal is not guaranteed or only guaranteed to a limited extent. The Foundation accepts no liability for any damage caused by restrictions or interruptions to the Foundation's web portal.
8. Duties and obligations of the insured person
In order to use the Foundation's web portal, the insured person must ensure that they have the hardware and software required for a connection to the Internet in accordance with the usual standards (Internet-capable configuration) (“work device”), in particular a browser supported by the Foundation.
The insured person undertakes not to misuse the Foundation's portal web application or the associated IT services and functionalities. In particular, he undertakes not to deliberately disrupt the web application of the web portal, not to disrupt, alter or damage Internet access or other networks and not to transmit any unauthorised advertising mail or other harassing messages (spam) or viruses or other harmful programmes (malware). The insured person further undertakes to use the Foundation's web portal in compliance with the rights of third parties (e.g. copyrights and trademark rights), not to violate any legal provisions and not to transmit or refer to any illegal or immoral content.
Intentional or grossly negligent disruption or impairment of the Foundation's web portal through improper use of work equipment and software is prohibited.
The Foundation reserves the right to block access to the web portal on an individual basis if the insured person uses the web application in breach of the contract or the law, if the insured person's work equipment jeopardises the smooth operation of the Foundation or if blocking serves to protect the insured person's data.
9. Access identification and authorisation
Onboarding is carried out in collaboration with those responsible at the Foundation's business unit. Authorisation is carried out by means of an onboarding letter and two-factor authentication.
The Foundation reserves the right to verify the identity of the user at any time if it has reason to believe that the information provided is incorrect. In such a case, the Foundation is authorized to block or cancel the portal account without the Foundation becoming liable to the user. However, the Foundation is not obliged to verify the identity of the user.
The user is solely responsible for keeping their access data secret and storing it securely. The same applies to any actions taken using the access data. The Foundation is not responsible or liable for the confidentiality and safekeeping of the user's access data or for any actions taken using the user's access data. In the event that there is a risk of unauthorized use of the access data by third parties, the user must inform the Foundation immediately.
If an insured person discovers that their access data has been disclosed to third parties without authorization or is being used by third parties without authorization, they must notify the Foundation immediately by sending an e-mail to the following address: pensionskasse.info@syngenta.com
A notification is deemed to have been duly made as soon as the Foundation has confirmed the notification by e-mail.
The Foundation considers any person who identifies himself/herself by means of the individually assigned access data to be authorized to use all services offered in the Foundation's web portal; this also applies in particular to the requested execution of business cases and simulations. The Foundation accepts no liability for damages arising from unlawful use or use of the access data or the web application that exceeds the assigned authorization.
10. Termination of access
Leaving the Foundation (vested benefits case) generally leads to the termination of the right of access to the Foundation's web portal. The exact time of termination of access for an insured person is determined by the Foundation.
